    REGISTRATION OF TRADEMARKS IN KENYA

    WHO CAN REGISTER A TRADE MARK?

    An individual, a company, a partnership, a society, a co-operative or any lawful association can apply for a trade mark provided they meet the requirements of the Trade Marks Act.

    The process of registering a trademark involves a thorough search of existing trademarks to make sure the proposed trademark is unique and not already in use. Once registered, a trademark owner has the exclusive right to use the mark in connection with the goods and services listed in the registration.

    It is important for businesses to protect their trademarks through enforcement and monitoring. This means taking legal action against any infringement of the trademark, such as unauthorized use by another company or counterfeiting.     REQUIREMENTS FOR REGISTRATION OF SOCIETIES IN KENYA

    Registration of societies which includes:Association,Welfare,Foundations,Alumni,churches etc, requires a number of  things to complete its registration.

    What are some of the requirements?

    • A maximum of three names in order of preference.
    • A letter explaining the meaning of names incase they are provided in vernacular language.
    • Three objectives of the society that you intend to register.
    • Officials details:-ID,Phone Numbers,KRA PIN,Postal  Addresses ,Passport  Photos (WITH A WHITE BACKGROUND) and Signatures (SIGNED ON A PLAIN PAPER SEPERATELY)
    • Members details same as those of the officials apart from the signatures.

    THE REGISTRATION PROCESS FOR SOCIETIES SHOULD TAKE UPTO A MAXIMUM OF 120 DAYS TO BE APPROVED DEPENDING WITH THE NATURE OBJECTIVES OF THE SOCIETY, THERE ARE THOSE THAT MUST UNDERGO VETTING PROCESS LIKE RELIGIOUS SOCIETIES AND FOUNDATIONS.
